The sale of products by Cooperativa Olivarera Virgen de la Sierra de Cabra S. Coop. And., hereinafter referred to as Coop. Virgen de la Sierra, is governed by these General Sales Conditions.
These General Sales Conditions are considered accepted without reservation by the Buyer. Furthermore, these General Sales Conditions shall take precedence over the buyer's general terms and conditions.
Coop. Virgen de la Sierra reserves the right to update the content of these General Sales Conditions.
1. Product Selection
The Buyer is solely responsible for selecting the product subject to the sale, as well as its intended use or function. Therefore, in line with the information provided in its catalogs, price lists, and/or general product information, Coop. Virgen de la Sierra shall not be liable or guarantee that the product is suitable for the applications intended by the Buyer or that it will fully or partially achieve the objectives envisaged by the Buyer when making the purchase of the products.
2. Transfer of Risks
Unless the terms of the invoice indicate otherwise, the risk is transferred to the Buyer upon the arrival of the goods at the destination indicated by the Buyer for delivery or at the time they are made available to the Buyer at Coop. Virgen de la Sierra's facilities for collection by the Buyer or on the Buyer's behalf. The risk is also transferred if the Buyer decides to delay collection.
3. Delivery Times
The estimated delivery time is 48 hours (after receipt of payment).
The delivery and shipment times will be counted from the acceptance of the order and are merely indicative. The Buyer shall not be entitled to any compensation for possible delays in delivery.
In the event that the Buyer is responsible for collecting the goods and fails to do so after they have been made available, Coop. Virgen de la Sierra shall have the right to store the goods or, after notifying the Buyer, proceed to their delivery or compensatory sale on the Buyer's account and risk. In the case of successive deliveries, if the Buyer persists in not collecting the goods, Coop. Virgen de la Sierra may terminate the purchase-sale commitment by consequently canceling that part of the order pending to be served.
4. Force Majeure
In cases of force majeure that hinder the delivery of the goods, Coop. Virgen de la Sierra shall have the right to delay it, and if the causes persist for more than 15 calendar days, to cancel the orders, without any obligation to compensate in any case. Force majeure cases shall be considered, among others, strikes, lack of transportation, accidents in the factories, fires, and in general, any cause independent of Coop. Virgen de la Sierra's will.
5. Claims
Only claims received by e-mail at despachodeaceite@monteoliva.com will be accepted. The deadline for claiming shall be 24 hours from the delivery of the product by the courier company to the customer.
6. Price and Payment
The prices shown on the website are prices including taxes.
The prices listed on the website may be modified without prior notice.
Coop. Virgen de la Sierra may cancel an order if it considers a typographical error or incorrect price of a product.
7. Discount Conditions
Coop. Virgen de la Sierra reserves the right to cancel or modify any type of promotion, whether in the form of a discount on the sale price or the dispatch of promotional gifts.
8. Penalty Clause
Coop. Virgen de la Sierra may initiate legal actions against any fraudulent order placed on this website.
9. Jurisdiction
The parties mutually agree that any dispute, regardless of its nature, relating to this sale, its performance, execution, and interpretation shall be under the exclusive jurisdiction of the courts of the place of Coop. Virgen de la Sierra's registered office, i.e., Cabra.
10. Personal Data Protection
Coop. Virgen de la Sierra will include the personal data provided by the Buyer through forms, online requests, product or service orders, or through any other means in the customer file.
This company guarantees the adoption of the necessary measures to ensure the confidential processing of such data and to prevent their alteration, loss, processing, or unauthorized access in accordance with current legislation. The Buyer who has data recorded in Coop. Virgen de la Sierra's customer file may exercise at any time the right to access, rectify, and, if applicable, cancel the personal data supplied to Coop. Virgen de la Sierra.
